City of Bedford, Virginia - At the Peaks of Perfection!

A regular meeting of the Council of the City of Bedford, Virginia, was held in the Council Hall of the Municipal Building at 7:30 p.m., May 8, 1990.

Members present: Mayor G. Michael Shelton; Councilman Larry D. Brookshier; Councilwoman Joanne A. Grahame; Councilman E. Thomas Messier; Vice Mayor John M. Owen, III; Councilman Ronnie C. Rice; and Councilman James A. Vest.

Members absent: None.

Staff present: City Manager Jack A. Gross; City Attorney W. W. Berry, IV; and Clerk of the Council Teresa W. Hatcher.

Mayor Shelton opened the meeting and led all present in saying the Pledge of Allegiance to the Flag.

Mayor Shelton declared that the minutes of a regular Council meeting held on April 24, 1990, were approved as mailed.

On motion by Councilwoman Grahame, seconded by Councilman Brookshier, voted upon and carried unanimously, the following item was added to the agenda: Resolution Regarding Proposed Industrial Development Authority Financing for Renovation and Improvement of County Office Space.

Vice Mayor Owen welcomed and introduced the Local Government Day City Council representatives and officials who were attending the Council meeting.

Mayor Shelton stated that the following items may be included on the agenda of the joint meeting with the Bedford County Board of Supervisors scheduled for May 15: 1. Possibility of Joint Landfill Operations; 2. Update on industrial certification activities in conjunction with the Chamber of Commerce; 3. Joint animal control shelter.

Mayor Shelton stated that the Chamber of Commerce has invited City Council and the Board of Supervisors to an informal picnic at their offices at 6:15 p.m. on May 15, prior to the joint meeting.

On motion by Councilman Brookshier, seconded by Councilman Vest, voted upon and carried unanimously, the following was added to the agenda: Executive Session - Litigation - Bedford County vs. the City of Bedford and Carriage Hill, Ltd. Lawsuit, pursuant to Section 2.1-344(a)(6) of the Code of Virginia of 1950, as amended; and Consultation with Legal Counsel and Staff regarding specifically the lawsuit pursuant to Section 2.1-344(a)(7) of the Code of Virginia of 1950, as amended.

The Clerk of Council read aloud the following public hearing notice:

 

NOTICE

SYNOPSIS OF BUDGET FOR FISCAL YEAR JULY 1, 1990 TO

JUNE 30, 1991, CITY OF BEDFORD, VIRGINIA

Notice is hereby given that a public hearing will be held by the City Council May 8, 1990, at 7:30 p.m. in the Council Hall of the City Municipal Building in relation to the budget for the City of Bedford for Fiscal Year 1990-91, at which time any citizen of the City shall have the right to attend and state his or her views. Detailed copies of the budget are available for inspection during normal office hours in the office of the City Manager and the office of the Clerk of Council.

 

Mayor Shelton opened the public hearing at 7:42 p.m.

City Manager Gross reviewed with Council highlights of the proposed budget.

Mr. Barry Thompson, Assistant to the City Manager, reviewed charts and graphs pertaining to the proposed budget.

As there were no further comments, Mayor Shelton closed the public hearing at 8:07 p.m.

The Clerk of Council read aloud the following public hearing notice:

 

NOTICE OF PROPOSED TAX INCREASE

The City of Bedford proposes to increase property tax levies.

1. Assessment Increase: Total assessed value of real property, excluding additional assessments due to new construction or improvements to property, exceeds last year's total assessed value of real property by 56.84 percent.

2. Lowered Rate Necessary to Offset Increased Assessment: The tax rate which would levy the same amount of real estate tax as last year, when multiplied by the new total assessed value of real estate with the exclusions mentioned above, would be $.5037 per $100 of assessed value. This rate will be known as the "lowered tax rate".

3. Effective Rate Increase: The City of Bedford proposes to adopt a tax rate of $.71 per $100 of assessed value. The difference between the lowered tax rate and the proposed rate would be $.2063 per $100, or 40.95 percent. This difference will be known as the "effective tax rate increase".

Individual property taxes may, however, increase at a percentage greater than or less than the above percentage.

A public hearing on the increase will be held on May 8, 1990, at 7:30 p.m. at the Council Hall of the Municipal Building.

All hearings shall be open to the public. The governing body shall permit persons desiring to be heard an opportunity to present oral testimony within such reasonable time limits as shall be determined by the governing body.

The provisions of this section shall not be applicable to the assessment of public service corporation property by the State Corporation Commission.

Notwithstanding other provisions of general or special law, the tax rate for taxes due on or before June 30 of each year, may be fixed on or before April 15 of that tax year.

 

Mayor Shelton opened the public hearing at 8:09 p.m.

As there were no comments, Mayor Shelton closed the public hearing at 8:10 p.m.

Local Government Day Mayor Brad Ellis read aloud the following proposed resolution:

 

RESOLUTION

WHEREAS, the observation of the functions of local government is of primary importance in the study of local government; and

WHEREAS, the seventh grade students of Bedford Middle School have, on May 8, 1990, participated in the local government process by observing these officials in the carrying out of their duties; and

WHEREAS, these students will, on May 9, 1990, conduct Local Government Day activities in the Council Hall of the City of Bedford;

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bedford, Virginia, that May 9, 1990 be, and it hereby is, designated as

LOCAL GOVERNMENT DAY

in the City of Bedford.

 

Councilman Brookshier moved that the resolution be adopted as read. The motion was seconded by Councilman Vest, voted upon and carried unanimously by the following roll call vote:

City Manager Gross stated that Bedford County is presently seeking financing under the Industrial Development Authority in order to remodel and improve County offices in the old Leggett Building. He stated that Section 15.1-1378 of the Industrial Development and Revenue Bond Act, Title 15.1 of the Code of Virginia, requires that the City consent to the financing of improvements through the Authority of facilities located with the boundaries of the City.

The Clerk of Council read aloud the following proposed resolution:

 

RESOLUTION OF THE CITY COUNCIL

OF THE CITY OF BEDFORD, VIRGINIA

REGARDING PROPOSED INDUSTRIAL DEVELOPMENT AUTHORITY

OF BEDFORD COUNTY, VIRGINIA FINANCING

WHEREAS, the County of Bedford, Virginia ("County") proposes to finance the renovation and improvement of office space in the City of Bedford, Virginia ("City") for use as administrative offices for the County ("Project") through a lease financing with the Industrial Development Authority of Bedford County, Virginia, ("Authority");

WHEREAS, the Board of Supervisors of the County has adopted resolutions on February 27, 1990, and May 7, 1990, authorizing the financing of the Project; and

WHEREAS, Section 15.1-1378 of the Industrial Development and Revenue Bond Act, Chapter 33, Title 15.1 of the Code of Virginia of 1950, as amended ("Act") requires that the City Council of the City consent to the financing through the Authority of any facilities located within the boundaries of the City:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEDFORD, VIRGINIA;

The City Council of the City concurs with the adoption of the attached resolution to be adopted by the Authority in connection with the financing of the Project for purposes of complying with Section 15.1-1378 of the Act.

This Resolution shall take effect immediately.

Vice Mayor Owen moved that the resolution be approved. The motion was seconded by Councilman Vest, voted upon and carried unanimously by the following roll call vote:

Mayor Shelton declared a five minute recess from 8:15 p.m. until 8:20 p.m.

Council proceeded to hold a work session on the proposed budget. Discussion ensued.

The City Manager is to place adoption of the budget on the agenda of the May 22 regular meeting.

On motion by Councilman Rice, seconded by Councilman Brookshier, voted upon and carried unanimously, Council adjourned into executive session to discuss: Executive Session - Litigation - Bedford County vs. the City of Bedford and Carriage Hill, Ltd. Lawsuit, pursuant to Section 2.1-344(a)(6) of the Code of Virginia of 1950, as amended; and Consultation with Legal Counsel and Staff regarding specifically the lawsuit pursuant to Section 2.1-344(a)(7) of the Code of Virginia of 1950, as amended. Council adjourned into executive session at 9:00 p.m. Non-council members attending were: City Manager Gross, City Attorney Berry, Clerk of the Council Hatcher, and Council-member elect Peyton Otey.

Council reconvened into open session at 10:21 p.m.

The Clerk of Council read aloud the following resolution:

 

BE IT RESOLVED that the Council of the City of Bedford hereby certifies that, to the best of each member's knowledge, (1) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (2) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Council.

 

On motion by Vice Mayor Owen, seconded by Councilwoman Grahame, voted upon and carried unanimously by a roll call vote, the resolution was approved:
