4-24-90 Minutes
A regular meeting of the Council of the City of Bedford, Virginia, was held in the Council Hall of the Municipal Building at 7:30 p.m., April 24, 1990.
Members present: Mayor G. Michael Shelton; Councilman Larry D. Brookshier (arrived at 7:40 p.m.); Councilwoman Joanne A. Grahame; Councilman E. Thomas Messier; Vice Mayor John M. Owen, III; Councilman Ronnie C. Rice; and Councilman James A. Vest.
Members absent: None.
Staff present: City Manager Jack A. Gross; City Attorney W. W. Berry, IV; and Clerk of the Council Teresa W. Hatcher.
Mayor Shelton opened the meeting and led all present in saying the Pledge of Allegiance to the Flag.
Mayor Shelton declared that the minutes of a regular Council meeting held on April 10, 1990, were approved as mailed.
Vice Mayor Owen reported that the student Local Government Day Council meeting may have to be held in the Middle School Auditorium because of the large number of students that will be attending.
On motion by Councilwoman Grahame, seconded by Vice Mayor Owen, voted upon and carried, the agenda was amended as underlined:
Executive Session: (1) Evaluation of City Manager and City Attorney; and discussion of personnel - Board of Equalization, pursuant to Section 2.1-344(a)(1) of the Code of Virginia of 1950, as amended. (2) Consultation and briefings with Dr. Muller and concerning intergovernmental relations; and consultation with legal counsel and staff regarding enforcement of ordinances on Shady Knoll Avenue, pursuant to Section 2.1-344(a)(7) of the Code of Virginia of 1950, as amended.
The Consent Agenda consisted of the following item: Appointment of Mrs. Trudy Thaxton to fill an unexpired term on the Central Virginia Area Agency on Aging, Inc., Advisory Council, said term to expire August 31, 1991.
On motion by Councilman Messier, seconded by Councilman Vest, voted upon and carried, the consent agenda was approved.
City Manager Gross reported that the Code of Virginia of 1950, as amended, requires that a city tax assessor be appointed to conduct the reassessment of real property.
The Clerk of Council read aloud the following proposed resolution:
RESOLUTION
WHEREAS, the Code of Virginia, as amended, requires cities such as Bedford to reassess property at intervals not to exceed four years; and
WHEREAS, 1990 is the fourth year since such reassessment; and
WHEREAS, the Code of Virginia, as amended, also requires that a city tax assessor be appointed to conduct such reassessment;
NOW, THEREFORE, BE IT RESOLVED that David R. Hickey be appointed as city assessor, such appointment to expire at the completion of the last working day on June 30, 1990, and that an attested copy of this resolution authorizing Mr. David R. Hickey to serve in this capacity be forwarded to the Director, Division of Real Estate Appraisal and Mapping, of the Commonwealth of Virginia.
Councilwoman Grahame moved that the resolution be adopted. The motion was seconded by Vice Mayor Owen.
Councilman Brookshier arrived at 7:40 p.m.
The motion was then voted upon and carried by the following roll call vote:

City Manager Gross stated that Council had received a draft of the preliminary budget for Fiscal Year 1990-91. Mr. Gross then reviewed with Council highlights of the proposed budget.
Mr. Barry Thompson, Assistant to the City Manager, reviewed charts and graphs pertaining to the proposed budget.
Discussion ensued regarding the Bedford County Board of Supervisors reducing the amount of funding to the Regional Library. Council instructed the City Manager to reduce Council's funding to the Library Board by a proportionate amount.
It was the consensus of Council to schedule a work session on the budget for the May 8th Council meeting as the last item on the agenda.
On motion by Councilman Brookshier, seconded by Councilwoman Grahame, voted upon and carried by the following roll call vote, Council adjourned into executive session to discuss: (1) Evaluation of City Manager and City Attorney; and discussion of personnel - Board of Equalization, pursuant to Section 2.1-344(a)(1) of the Code of Virginia of 1950, as amended. (2) Consultation and briefings with legal counsel and staff concerning report by Dr. Muller and concerning intergovernmental relations; and consultation with legal counsel and staff regarding enforcement of ordinances on Shady Knoll Avenue, pursuant to Section 2.1-344(a)(7) of the Code of Virginia of 1950, as amended.

Council adjourned into executive session at 8:15 p.m. Non-council members attending were: City Manager Gross, City Attorney Berry, Clerk of Council Hatcher, Chief of Police Russell, Peyton Otey, and
Dr. Thomas Muller.
Council reconvened into open session at 11:21 p.m.
The Clerk of Council read aloud the following resolution:
RESOLUTION
BE IT RESOLVED that the Council of the City of Bedford hereby certifies that, to the best of each member's knowledge, (1) only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting to which this certification resolution applies, and (2) only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Council.
Councilwoman Grahame moved that the resolution be adopted as read. The motion was seconded by Councilman Brookshier, voted upon and carried unanimously by the following roll call vote:
